Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student", "you" or "your") and Jyotish Vidya Academy Ltd. (Company No. 14523891), registered at 71 Gloucester Place, London, W1U 8JW, United Kingdom ("the Academy", "we", "us" or "our"). By creating an account, enrolling in a programme or otherwise using our website at academy-jyotish.pro, you confirm that you have read, understood and agree to be bound by these Terms in their entirety.

1. Definitions

In these Terms, the following definitions apply:

• "Platform" means the website located at academy-jyotish.pro, including all pages, subdomains and digital tools operated by the Academy.
• "Programme" means any course, workshop, masterclass, mentorship module or certification track offered by the Academy through the Platform.
• "Content" means all materials made available through the Platform, including but not limited to video lectures, written materials, chart templates, slide presentations, audio recordings, quizzes and assessment exercises.
• "Account" means the personal student profile created upon registration, through which you access enrolled Programmes.
• "Fees" means the tuition charges applicable to a Programme as published on the Platform at the time of enrolment.

2. Account Registration

2.1 Eligibility

You must be at least eighteen (18) years of age to create an Account and enrol in a Programme. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate, current and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you become aware of any unauthorised use of your Account. The Academy shall not be liable for any loss arising from your failure to safeguard your credentials.

2.3 One Account Per Person

Each Account is personal to you. You may not share your Account credentials with any other person or permit another individual to access Programmes through your Account. We reserve the right to suspend or terminate any Account where we reasonably suspect shared access.

3. Programme Access

3.1 Enrolment

Enrolment in a Programme is confirmed upon successful payment of the applicable Fees. Upon confirmation, you will receive access to the Programme Content in accordance with the published curriculum schedule.

3.2 Duration of Access

Unless otherwise stated on the Programme page, you will have access to enrolled Programme Content for a period of twelve (12) months from the date of enrolment. Lifetime access, where offered, is subject to the continued operation of the Platform.

3.3 Mentorship and Live Sessions

Certain Programmes include live mentorship sessions, group Q&A calls and one-to-one consultations. Scheduling of these sessions is subject to mentor availability. The Academy will make reasonable efforts to accommodate your preferred time slots but cannot guarantee specific scheduling.

3.4 Modifications to Programmes

We reserve the right to update, modify or restructure Programme Content to reflect developments in Vedic astrology scholarship, pedagogical improvements or regulatory changes. Where material changes affect an active enrolment, we will notify you in advance and, where reasonably practicable, provide access to both the original and updated versions for the remainder of your access period.

4. Intellectual Property

4.1 Ownership

All Content on the Platform, including text, graphics, logos, videos, audio recordings, chart templates, assessment materials and software, is the property of Jyotish Vidya Academy Ltd. or its licensors and is protected by copyright, trademark and other intellectual property laws of England and Wales and international treaties.

4.2 Limited Licence

Upon enrolment, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view Programme Content solely for your personal, non-commercial educational purposes. This licence does not permit you to:

• Copy, reproduce, distribute or publicly display any Content;
• Record, screen-capture or otherwise create derivative copies of video lectures or live sessions;
• Share, resell or sublicence access to any Content or Programme;
• Remove or alter any copyright, trademark or proprietary notices.

4.3 Student Submissions

You retain ownership of original works you submit as part of assessments (such as chart analyses and written interpretations). By submitting such works, you grant the Academy a non-exclusive, royalty-free licence to use them for assessment, quality assurance and internal training purposes.

5. Payment Terms

5.1 Fees and Currency

All Fees are quoted in British Pounds Sterling (GBP) unless otherwise indicated. Prices are inclusive of VAT where applicable. The Academy reserves the right to adjust Fees for future Programmes; however, the price confirmed at the point of your enrolment will be honoured.

5.2 Payment Methods

We accept payment by major credit and debit cards, PayPal and direct bank transfer. Payments are processed securely through our third-party payment service providers. The Academy does not store full card details on its servers.

5.3 Instalment Plans

Where instalment plans are available, the terms (number of instalments, amounts and due dates) will be clearly displayed before you confirm your enrolment. Failure to make an instalment payment by the due date may result in suspension of your access to the Programme until the outstanding balance is settled.

5.4 Late Payments

If any instalment remains unpaid for more than fourteen (14) days after the due date, we reserve the right to charge interest at the rate of 2% per annum above the Bank of England base rate, calculated on a daily basis from the due date until payment is received.

6. Cancellation and Refunds

Our cancellation and refund provisions are set out in detail in our Return and Refund Policy, which forms an integral part of these Terms. By enrolling in a Programme, you acknowledge that you have read and accepted the terms of that policy.

7. Limitation of Liability

7.1 Educational Nature of Services

The Programmes offered by the Academy are educational in nature. Content relating to Vedic astrology, including planetary interpretations, dasha analyses and predictive techniques, is provided for learning purposes and does not constitute professional advice in financial, medical, legal or psychological matters. You acknowledge that astrological interpretations are inherently subjective and that the Academy does not guarantee any specific personal or professional outcomes from completing a Programme.

7.2 Limitation

To the maximum extent permitted by law, the Academy's total aggregate liability to you for any claims arising out of or in connection with these Terms or your use of the Platform shall not exceed the total Fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

7.3 Exclusions

The Academy shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity or loss of goodwill, whether arising in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages.

7.4 Statutory Rights

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of England and Wales.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any references to legislation include that legislation as amended, re-enacted or replaced from time to time.

9. Dispute Resolution

9.1 Informal Resolution

In the event of any dispute arising out of or in connection with these Terms, both parties agree to attempt to resolve the matter amicably through good-faith negotiation. You may contact us at [email protected] to initiate this process.

9.2 Mediation

If informal negotiation does not resolve the dispute within thirty (30) days, either party may refer the matter to mediation administered by the Centre for Effective Dispute Resolution (CEDR) in London. The costs of mediation shall be shared equally between the parties unless the mediator directs otherwise.

9.3 Jurisdiction

If the dispute is not resolved through mediation, the courts of England and Wales shall have exclusive jurisdiction to hear and determine any proceedings arising out of or in connection with these Terms.

10. Amendments

We reserve the right to amend these Terms at any time. When we make material changes, we will update the effective date at the top of this page and notify registered Students by email at least fourteen (14) days before the revised Terms take effect. Your continued use of the Platform after the revised Terms come into effect constitutes your acceptance of those changes. If you do not agree with the revised Terms, you should discontinue use of the Platform and contact us regarding any active enrolments.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy and Return and Refund Policy, constitute the entire agreement between you and the Academy with respect to your use of the Platform.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

11.3 Waiver

No failure or delay by the Academy in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

11.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. The Academy may assign its rights and obligations to a successor entity in the event of a merger, acquisition or sale of substantially all of its assets.
